Ousted President Thabo Mbeki has approached the Constitutional Court for leave to appeal Judge Chris Nicholson's inference that as the head of state he interfered with the NPA's prosecution of ANC leader Jacob Zuma.
The Star will reveal on Tuesday that Mbeki - in his personal and official capacity as president - alternatively wants the highest court in the land to set aside Nicholson's inference of wrongdoing against him and his cabinet.
"It is unfair and unjust for me to be judged and condemned on the basis of the findings in the Zuma matter. The interests of justice, in my respectful submission, would demand that the matter be rectified," Mbeki said in the court papers that name Zuma as respondent.
ANC secretary-general Gwede Mantashe said on Saturday that the ANC has "recalled" Mbeki as president of the country after his cabinet announced an intention to "reverse" Nicholson's ruling.
