Angry MPs reject Karamagi’s Energy, Petroleum Bill

MEMBERS of Parliament refused unanimously Saturday to listen to Energy and Minerals Minister Nazir Karamagi and his team of resource persons at a seminar convened to discuss The Electricity Act, 2007 and the Petroleum Supply Act, 2007.

The MPs demanded almost angrily to see the report of the probe team on the controversial Richmond contract before they discuss the bills which they said “would not help this country’s economy” anyway.

Mr George Simbachawene (Kibakwe – CCM) was so irritated that he wrote a note to the seminar Charman, Dr Harrison Mwakyembe (Kyela – CCM), saying: “I wish to die soon so that I do not witness the plight of future Tanzanians who would not have electricity.”

He also wrote that future generations in this country would watch helplessly as so-called investors exploit their minerals. “These Tanzanians would the houseboys and girls in the homes of these rich foreign masters.”

Energy Minister Karamagi walked out of the meeting head-down without being given chance by the incensed MPs to respond to their sentiments.

Some legislators, who wished to remain anonymous, hinted that the current Bunge session would be stormy.

During emotional exchanges with the seminar chairperson, Ms Anne Malecela (Same East – CCM) charged that some people in government thought MPs were stupid.

“This parliament is made up of upright men and women. There are no fools in here,” she said, adding that she suspected some high-placed people in government had impoverished Tanesco.

“We want to know exactly the reasons that brought on Tanesco’s critical financial problems. The company is in the Intensive Care Unit (ICU),” she said.


Addressing Minister Karamagi, the Same East legislator banged her desk charging: We will not discuss your Bills even if we sit in here until tomorrow. Not even for four days.”

Dr Raphael Chegeni (Busega – CCM) demanded that privatization should be stopped.He said, “We have come to a point where privatization has thrown us into utter confusion and deeper poverty.”


He told fellow legislators to refuse to be used as rubberstamps. “We should do what is expected of us by Tanzanians. Short of this we all should resign.”

Mr Said Amour Arfi (Mpanda Kati – Chadema) charged that the reasons that threw Tanesco into the ICU were political. He said some of the power supplies are located in uneconomic zones. He also demanded to know why Artumas used Tanesco power lines.


Mr Benson Mpesya (Mbeya Urban – CCM); Mr Abdulkarim Shah (Mafia – CCM); Mr Herbert Mntangi (Muheza – CCM); Mr Job Ndugai (Kongwa – CCM) and Mr Juma Killimbah (Iramba East – CCM) demanded separately that the seminar be closed.

Mr Michael Laizer (Longido – CCM) did not see why MPs who hail from districts that do not have power were in the seminar. “Why should we discuss these Bills? Our districts do not have electricity. And what happened to rural electrification schemes?”


Mr Laizer told the chairman to close the seminar because the legislators were not in the mood to discuss anything substantial.

Mr Hamad Rashid Mohamed (Wawi – CUF), criticized the Bills saying not enough effort had gone into their formulation.

The Electricity Act, 2007 seeks to provide for the facilitation and regulation of generation, transmission, transformation, distribution, supply and use of electric energy for cross border trade in electricity and planning of rural electrification.


The Petroleum Supply Act, 2007 envisages making provisions for importation, exportation, transportation, transformation, storage and wholesale and retail distribution of petroleum and its products in a liberalized market.

Mie nasema safi sana, isipokuwa nimesikia PM kaandaa semina specific kwa wabunge wa CCM kuijadili issue ya Richmonduli na hiyo ya BoT na hapo ndipo ukweli hupindishwa. Kwa kweli tumechoka jamaniiii mwe, Kalamagi naye kakomaa tu kwanini asijiuzulu. Halafu mzee Sitta naye(Spika) kweli anazeeka vibaya na lazima ieleweke kuwa amemnyanyasa sana kijinsia naibu Spika mama Makinda kwa kumzuia asiendeshe mjadala wa Richimonduli akiwa hayupo!! Sisi wananchi tunajua aliyeondoka ni Samwel Sitta na siyo ofisi. Hivi jamani hatuombei lakini ghafla spika kaumwa au ndo kavuta kabisa itakuwaje? hakutafanyika mijadala?   18. PLEASE! do not be fooled. These MP's are just trying to save face after doing such a poor job all along. After all, aren't they the ones who allowed us in this situation to begin with?

    Malecela claims the Bunge is not made up of fools, yet Karamagi is in the Bunge, is he also one of the one's she is defending? They are all on the committee that allowed Tanesco to get to the point it is now at. She is just trying to make it look like they care.

    And Chegeni is now saying they should stop privatization??? We know that CCM does not really believe this or they would not be welcoming BUSH with open arms this week. He is not coming out of great concern for Tanzanian people, but only to secure more rights for his companies to steal wealth from our soil. Every American President tours the world in his last year in office in order to make it look like he cares. He is just trying to boost his image before he leaves office.

    These same MP's who claim to be against privatization will be welcoming the Sullivan Summit with open arms, which is just a big Auction for foreigners to come in and buy up whats left of Tanzania's resources.

    It is good they spoke up abuot this issue, but don't be fooled by their words. Let's wait and see if there is any substantial follow up with action.

    Huyu MP wa longido alikuwa na kashfa ya Rushwa wakati anagombea uenyekiti wa CCM wa Mkoa akapigwa chini, inawezekana ndio anamalizia hasira kwa PM ambao kiasili hawapatani.

Mimi swali langu rahisi ni Kwamba Tunaposema wanafanya vibaya tuna maana kuna watu fulani fulani wanao stahili kuwajibishwa! ama sio, kama jibu ni ndio je ni nani Tz alishawahi kuwajibika ama kuwajibishwa? Na ni nani alaumiwe.

    Tanzanian PS Summoned Over Bank Sale

    TANZANIA'S PARLIAMENTARY Accounts Committee (PAC) has summoned the Permanent Secretary in the Planning Commission, Mr Charles Mutalemwa, for an in-depth explanation on the controversial sale of NBC (1997) Ltd to Amalgamated Banks of South Africa (ABSA).

    The PAC summon comes in the wake of new revelations that ABSA, which has yet to buy the former state-owned National Bank of Commerce (1997) Ltd, illegally transferred $8 million to South Africa in October, 1999, without authority from the Bank of Tanzania.

    It was returned on February 27, plus $133,000 as interest.

    By some twisted sense of logic, President Benjamin Mkapa appointed an ABSA official, Mr Gerald Jordaan, to manage NBC ahead of the bank sale when ABSA was to assess if it could buy the 70 per cent shares at Tsh15 billion ($18 million) in Tanzania currency. Even before concluding the deal, ABSA is already discovered remitting NBC money, without BoT permission, a matter that lead the PAC to question the sale deal.

    The PAC Chairman, Mr John Cheyo, told The EastAfrican last week that the committee had set March 14 as the day when Mr Mutalemwa is expected to appear before the PAC.

    The decision to summon Mr Mutalemwa was made by the Committee on discovering that the bank sale process lacked transparency and last week's revelations by The EastAfrican called for detailed explanations.

    Even after press conferences by the ABSA managing director, Mr Jordaan, and a high-powered joint press conference called by Finance Minister Yona, BoT Governor Daudi Balali and the Chairman of the Parastatal Sector Reform Commission (PSRC) Mr John Rubambe, the PAC and the Tanzania media are still suspicious the deal was skewed in favour of the South Africans.

    The best Minister Yona could reveal was that Tanzania signed seven conditions for the sale to ABSA, the payment of $18 million to ABSA among them, but declined to name the other six conditions.

    The EastAfrican had revealed that the state-owned National Micro-finance Bank (NMB), a splinter bank from NBC, owed the NBC (1997) Ltd Tsh15 billion ($ 18 million), a sum equal to what the ABSA is supposed to pay the Tanzania government. The latter has not paid a cent to this date, although it signed a sale agreement on December 20 1999, but is running it as bought.

    "The PSRC is under the Planning Commission, so the PAC has decided to call upon its Permanent Secretary to clear the air on the whole deal," Mr Cheyo told The EastAfrican.

    The EastAfrican has also learnt that ABSA in October 1999, secretly transferred $8 million (Tsh6.4 billion) secretly from NBC (1997) Ltd to Standard Bank of South Africa without BoT approval. However, when the BoT banks supervisor discovered the illegal transfer, BoT fined the NBC by debiting its BoT account, by Tsh253 million ($316,250) instead of fining ABSA.

    Bank sources told The EastAfrican that, despite insistence by BoT that it return the $8 million "immediately," ABSA waited for five months.

    The $8 million was transferred by ABSA to the South African Bank, Standard Bank, that re-transferred it to a bank in the UK.

    Contacted for comment, the secretary to the acting managing director said all questions on the bank sale must wait for the return of the managing director, Jordaan, who is on a two-week tour of Shinyanga, Mwanza, Tabora and Kigoma regions.

    The bank source said: "ABSA violated several regulations, including the provision that money must be remitted to a specific bank account, in a bank whose liquidity position is known, upon being permitted by BoT."

    Its has also been discovered that the ABSA management is an expensive outfit that spends millions of NBC dollars every week catering to their lavish perks, including accommodation, food, transport and monthly return flights to South Africa.

    The bank source said the NBC, which is supposedly in the red and therefore must be sold cheaply, was supposed to pay out between $1000 to $2000 a week for the first 45 days from the second half of 1999 but have overstayed by eight months receiving the same perks.

    The EastAfrican reported in last week's issue that the first instalment of Tsh7.5 billion ($ 9 million) was paid out by NMB to NBC (1997) Ltd on February 28. Asked where the NMB got the money, the NMB board chairman, Mr Ibrahim Kaduma, replied: "From customers' deposits." NMB is directed to pay the remaining half by February 28, 2001.

    However, while Tanzanians have all along been given the impression that the NBC had been sold to ABSA, Minister Yona surprised the public when he admitted it hadn't exchanged hands but awaited fulfilment of seven conditions, which he declined to name.

    When Yona and his BoT Governor and the PSRC chairman spoke, the trio said the claimed Tsh15 billion for ABSA was "discovered" by an audit team. While Jordaan says it was the Tanzania Audit Corporation, bank sources have revealed it was conducted by Mr Charles Singili of NBC and Patrick Kyamba of NMB after the sale had been concluded.

    The EastAfrican has learnt that the NBC Holding Corporation, that was also split from the original NBC, owes the South Africans another Tsh1 billion (1.25 million) in similar circumstances. Thus ABSA is seeking to be paid by Tanzania $20 million in order to buy the NBC at $18 million.

    Meanwhile, press reports in Tanzania revealed that the hitherto unnamed conditions for sale of the NBC (1997) Ltd to ABSA is basically only one – exemption of all taxes. This condition must be met by Tanzania before it pays in Tsh15 billion ($ 18 million) in Tanzania shillings before the end of March for ABSA to buy the 70 per cent shares.

    The other ABSA condition for purchase of the state-owned bank is exemption from taxes on transfer of shares relating to the privatisation.

Someni alama za nyakati, kuna mmoja hapo alikuwa ana uhakika 100% kuwa angekuwa waziri wa madini na nishati na anatokea huko huko kunako madini na JK hakumchagua waziri wa nini wala nini ingawa matangazo yalienea. Of course Karamagi ana mapungufu yake, lakini hao wote wako chungu kimoja ila sasa umefika wakati wa kila mtu kuangalia sumata (sanduku la chuma la kuendea shule) lake. Hawana mpya hao, hao si ndio walivyoingia bungeni tu cha kwanza wakadai nyongeza ya maslahi yao hata kabla hawajafanya tulichowatuma hukoo? Si ndio waliokuwa wakipinga hoja za kutoka upinzani na kung'ang'ania kutetea serikali utafikiri ni wabunge/watumishi wa serikali?
