THE Bank of Tanzania (BoT) paid some 30.8 million US dollars (about 40bn/-) to a suspicious local company claiming to have been assigned debts owed to 12 foreign creditors in 2005, the 'Daily News' has learnt.
This is the subject of a special audit ordered by Finance Minister Zakia Meghji on the National Bank of Commerce External Payments Arrears (NBC-EPA) Account, which is administered by BoT on behalf of the government. Under the scheme, local companies negotiated settlement of foreign creditors’ debts and received deeds of assignments, which they presented to BoT for redemption in local currency.
According to a report by BoT’s external auditors last September obtained by this newspaper, the questionable payments in relation to debts owed by 12 European, Japanese and US creditors, were paid to Kagoda Agriculture Limited, which presented deeds of assignment signed between September 10 and November 3, 2005.
“The above time period appears too short to have negotiated and signed assignments of debt with twelve different foreign creditors from across the globe,” said the report addressed to BoT Governor Daudi Ballali.
The auditors said all the deeds were signed in Dar es Salaam and witnessed by B.M. Sanze Advocates, Notary Public and Commissioners of Oaths. Nine deeds were signed on October 18 and 19, 2005. “This implies that all the foreign creditors travelled to Dar es Salaam to sign these deeds on more or less the same day,” the auditors pointed out.
They said two deeds purported to have been assigned by German companies Lindeteves J Export BV and Hoechst were quoted at 1,164,402/76 Euros instead of being quoted in Deutsche Marks, the German currency. But despite writing to Kagoda to point out the mistake, BoT went ahead to release 8.2bn/- to the company.
The auditors found that the guarantees, which were signed on October 18, were revised two days later and re-lodged with BoT, suggesting that the creditors’ representatives were still in the country or returned at such short notice.
The auditors questioned why the 12 deeds purported to have been issued by different companies bore the same terms and wording and were signed only on the last page. The seals found on the documents were identical to that of Kagoda. It was further found that the papers used for the deeds had no letter heads and the names of the creditors were outdated.
None of the people alleged to have signed the deeds on behalf of the German, Italian, British, Japanese, Yugoslav, French and US companies could be identified by the creditors when contacted by the auditors. “We find it concerning that a company formed on September 29, 2005 was able to be paid US$30.8 million within five to six weeks of its formation. We are not aware of any background checks performed by the bank,” said the auditors.
The report warned that the suspicious transactions involving Kagoda might not be isolated incidences. “The use of old names for companies and the speed with which the transactions were approved could also suggest collution with senior employees within the Bank,” it pointed out.
The report dated last September 4 recommended immediate thorough investigations during which employees involved with the transactions should be suspended, but the relevant officials have not been touched and the special audit is yet to start.
A search at Business Regulatory Licensing Authority (BRELA) by the 'Daily News' in Dar es Salaam yesterday confirmed that Kagoda Agriculture Limited has been registered. It is owned by city residents Francis William (60 per cent) and John Kyomuhendo, who the auditors say signed the BoT requisition papers, (40 per cent).
Sources disclosed that Controller and Auditor General, has invited quotations from seven international consultants operating in the country to carry out the special audit, which is expected to start in the middle of next month.
It is alleged that billions of shillings were misappropriated under the government external debt service account administered by BoT.
