I have been following with keen interest the on-going dispute and media frenzy involving the newly appointed Lands, Housing and Human Settlements minister Anna Tibaijuka and a prominent city businessman and advocate, Taher Muccadam.
At the center of this sensational contention is plot number 1006 near the Palm Beach Hotel. According to the Minister, the plot has been an open space for over 30 years and should remain so but per the statements made by Advocate Muccadam, he is the rightful owner of the plot and that he acquired the land following a lengthy due process.
There were several plots that the Minister has expressed desire and intent to seize from private hands but I will focus on this particular plot because this is the plot that got the most media attention. We were able to hear from both sides of this wrangle to give any objective observer a basis to form an informed opinion.
There are many lessons to learn from this on going bicker, lessons which are extremely disturbing. I will jump straight into elaborating what lessons I have learned.
The Government has shown absolute disregard for the judiciary. The plot in question was the subject of a lengthy legal battle at the High Court which culminated into a verdict that the advocate was the rightful owner.
The Minister’s decision to demolish the fence walls on a plot makes one wonder where does the Government get the mandate to disrespect and belittle our respected judges and the judicial system as a whole. When suspects of the EPA scam were dragged to court, there was an increased public anxiety and discontent because citizens wanted to see a much quicker and aggressive prosecution of the case.
The President gave a highly commendable and rationale response by stating that legal issues must be handled with due diligence otherwise the Government could be vulnerable to substantial lawsuits. A few days ago the Prime Minister made a statement on the decision of the International Chamber of Commerce to award Dowans $124 million, in principle he stated that that Government respects the verdict.
These two powerful leaders of the Government have taken a position to respect rule of law even if upholding those values comes with a price. It would have been expected that the rest of the Cabinet would also stand behind this important precedent that is required to build a progressive civil society.
To the contrary the Lands Ministry took a decision that is absolutely contradictory to the precedent set by the President and the Prime Minister. The official Government position on the judicial system has been seriously impaired.
This situation can potentially erode investor confidence and be counter productive to Government efforts in enticing investments . One of the functions of most diplomatic missions in the country is to advise their citizens on Tanzanian investment climate and Government actions form a key component in assessing business climate.
If a citizen who is an attorney by trade can have his land rights revoked by a Ministerial memo which is contrary to High Court decision why should any vigilant investor expect any assurance for the safety of his investment? This heightened sense of insecurity is also impacting other citizens too because nobody can feel safe and comfortable that the Courts orders would not be honored by authorities.
It was reported by the media that the Principal Secretary in the Ministry of Lands has ordered Ilala Municipality leaders to revoke the building permit, one does not need a law PhD to figure out that the Government did indeed issue a permit because it is illogical to revoke something that does not exist, until when is the Ministry going to play these games of issuing permits and revoking them at without impunity?
It appears the Government has no real solutions to address land issues. In developed countries one can literally be living in one end of a country and make an effective land or any real estate acquisition in the other end of the country by the use of internet and telephony technologies. A buyer can obtain all information about the asset such as ownership history, property taxes etc prior to making the purchase.
This is possible because Government institutions that are responsible to provide these services have processes in place that are customer oriented and they mean business. In Tanzania the Lands Ministry is extremely notorious for inefficiencies and bureaucracy.
It is not uncommon to hear of double and triple land allocations, processes are unclear and even documents that are issued from official desks of the Ministry can end up being bogus. For how long will Tanzanians continue to suffer these ridiculous inefficiencies and abuses?
Tanzanian journalism profession has been seriously compromised by incompetent writers, people who call themselves journalists simply because they can compose a few sentences. Some writers have been dancing to the tunes of political populist melodies to the extent of questioning how could the advocate have the nerve to challenge a Minister.
They used languages like ‘kutunisha misuli’ and all that crap. Well, to those journalists who equated the advocate’s response to arrogance I have a question for them, doesn’t the Constitution of this country give every citizen the right to initiate a litigation even if the defendant is the Government? How many years do they need to evolve from that primitive colonial mentality that the Government cannot and should not be challenged in the court of law?
There are two main possibilities in this madness, either the Government does indeed issue these plots and building permits and then they turn around to change their position at a cost to citizens or another possibility is that those who claim to own the plots do so on the basis of fraudulently acquired documents.
If the Government has indeed issued these rights the Government must honor and keep its word and stop this madness of tearing down properties that they themselves approved to be erected. If they want to entertain the culture of inconsistency and unpredictability the Government must be prepared to compensate the affected parties according to the law.
If the plot owners have fake documents I challenge the Government to prosecute all such land owners for fraud first before resorting to forceful nationalization in the name of re-acquiring Government properties.
At least this way the Government will have proven beyond reasonable doubt that the culprits are actually land owners and not its own decision making officials and it will be a manifestation of respecting the legal process.
If the Government took the steps to prosecute EPA suspects for fraud as a step towards recovering the stolen money why doesn’t the Government apply the same principle and observe rule of law in disputed land deals? Why double standards?

ReplyDeleteTanzanians are so paranoid people. The Ujamaa system is running in their DNA. There have never been a case where the government respect the rule of law. The high courts don't mena much when the verdict is not respected. That is why, the few foreign companies in Tanzania insist in settling disputes with Tanzanian government in Switzerland or the U.K.
ReplyDeleteI remember very well the case of the ownership of Drive-In. The owner was denied his right to sell the land to the U.S government to build the embassy. The government didn't want an Indian to make so much money though they didn't mind him owning Drive-In Cinema. The court said the Indian had the right to sell the property but Mkapa refused to let the deal through and insisted that the US government buy it from the state.
The government allows individiduals to sell NHC property to others for profit (the ownership still remains with NHC but new renter pays more in rent). This shows that the government still does not respect the rule of law nor encourage investors.
Tanzanians will forever be poor. We are jelous of rich people, we don't work hard, we drink alot and we have no imagination. The government is still very much socialist in teh way it deals with the business community. The only people who can give jobs to the majority of Tanzanians are private businessmen. As long as they feel harassed, the country will not develop and the government cannot afford to feed,house or provide employment to all. The mentality of the government and people must change if we need serious investors in the country.

Nikijenga ghorofa tano, kwa sababu mtu wa ardhi kaipitisha legally wakati hio haikutakiwa kuwa hivyo inamaanisha serikali inabidi ikubali? Kama kuna sheria inayosema eneo fulani ni "public area", mtu kupata kibali cha kujenga hapo haimanisha sheria imebadilika. The individual is only right kama serikali ikibadili yale maandishi yanayosema hili eneo ni 'public" na kusema hili eneo "si public".
Na ni jukumu la the individual kuonyesha kwamba kweli serikali ilibadilisha. Kupewa kibali sio kuwa na haki..kama hivyo na mimi ningekuwa na viwanja vyangu viwili kunduchi...

Nchi yetu bado changa..so tuachane na hizi comparison za machungwa na maembe. Jirani wetu ambaye nauhakika umemtumia in some occasions kama 'an example to follow" amefanikisha kwa sababu at times, the government his govt has to do what it has to do. Nchi haitasogea bila muda mwingine serikali kuamua hayo. Ya Dowans hawana jinsi, maana mwenye shida hawezi kubana njia ya chakula, lakini kwa maswala ya hapa hapa bongo government can/should fight for what is right.
Lessons to learn according to US blogger:

3. Tanzanians have no rights to have open spaces and if the government revoked the fraudulently acquired plot (which was planned an open space) is an act of repelling investors
4. Journalists should refrain from using such jargons as "kutunisha misuli". They should use dictionary language instead
5. Colonial governments were not challenged before the court...
6. Muccadam is a competent advocate and investor, therefore the government should respect his doings

1. How far are we sure that Mr Muccadam acquired the plot legally. He has promised to sue the government, let us wait and see the fate. But we should be mindful that an item acquired illegally is illegal. Ia m not saying Honourable Muccadam acquired the land unlawfully!
2. Tanzanians should not suffer just for the sake of investors.
3. We should think twice when comparing cases. Comparing US and Tanzania in terms of technology development and utilization is a good thing; but the question is: This comparison is towards which end?

Some of the guys before me are on the spot with the lessons mr Blogger presented,however
ReplyDeleteI read them and i must say,it is enthralling and has been pitched it well and my only view of the issue is that....
sometimes goverments get it wrong and there are varying and different opinions on approved issues due to time'30 years' differences,the persons at helm at that time could have lacked skills,experience and bearing in mind rampant corruptions in the eighties due to the standard of life,remember,at that time the country courses started to be rethought etc...,there are number of redundant policies some you might be well aware of....and a thirty year rule,by today,could have suffered from not being relevant and significant enough hence would likely to warrant amendments.
Moreover,some goverment policies were and are still, prone to exploitation due to loopholes and obscurities which deter governments from making amendments for fear of litigation..in which,eventually,they will have to pay up.....
That said,my perception of public interest comes in the mix in the sense that the general welfare to its citizens is imperative to bringing about social economic development.So,if they spotted flaws that make achieving their goals difficult and hindered,then,they will have to launch into the matter and solve it at any cost of compensation.'the business man is gonna sue'..well let him and see how he is going to be dispatched...,we see governments paying up costly errors for the sake of reacquisition....
Anyway,had I gotten a fairly exposure of the land disputes and proceedings ,I could have thrown caution to the wind and discuss the affair extensively.

ReplyDeleteTatizo ninaloliona hapa ni kwamba, muandika hoja haijui sheria ya ardhi ya kiutamaduni hata kabla ya sheria za kikatiba hazijarithishwa katika mifumo ya serikali za kileo. Ardhi ni mali ya serikali-serikali ni wananchi halali wa nchi husika. Kwa hiyo basi, ardhi ya tanzania ni mali ya wananchi wa tanzania wakisimamiwa na viongozi wake. Pale ambapo tutapata viongozi bomu ambao wapo kwa ajili ya maslahi yao wenyewe ndipo pale sheria zinapopindishwa ili wenye fedha wapate watakacho, na hii ndiyo case ninayoiona kwa huyu mmiliki wa ardhi hii tunayobadilishana maneno. Kama lingekuwa ni shamba la mkulima ama mtanzania mlalahoi basi ingekuwa ni hadithi iliyopitwa na wakati-lakini kwakuwa hili ni eneo ambalo katika mipango miji lipo kama eneo la wazi basi unaweza ukacheat wilayani tu, au labda una fedha na mkoani ukafanya hivyo lakini katika level ya taifa hauwezi kubadilisha chanya kuwa hasi. Watu wenye kujua umuhimu wa kuyaacha maeneo hayo wazi wanapoona hilo hata kama ulitumia sheria kupindisha sheria utanyang'anywa tu. Hongera Mama Tibaijuka.
Na huyu wa US embassy aliyetoa comment yake si mzalendo kama ambavyo Wamarekani wasivyo wazalendo kwa nchi yetu. Tunarudi pale pale, ardhi ya nchi hii ipo chini ya mamlaka ya wananchi wa tanzania kupitia viongozi waliopo-pale ambapo serikali itaamua kufanya biashara ya ardhi kwa kufuata sheria iliyopo ili mapato yaingie si kukimbiza wawekezaji.
Pili, tanzania hatujawahi kupata wawekezaji, tumewahi kupata majangili,waizi na wenye tamaa ya kukwapua uchumi wa nchi-na tatizo kubwa ni kwa kipindi kirefu kuwa na viongozi wabovu. Hii inajionyesha wazi kwa kuwa hakuna muwekezaji aliyekuja kuomba msitu au pori akawekeza bali wote wanataka majengo ya ndani ya mji, wavunje na kuwekeza hata kama eneo haliruhusu ujenzi wa ghorofa watafanya hivyo na kumega vipande vya viwanja vilivyo wazi-hii si sahihi.
Kama mnataka kununua ardhi nendeni Kenya, India, Rwanda, Burundi, Marekani na kwingineko mtapata. Msilete hoja ambazo zinaonyesha wazi kuwa watanzania weupe (wahindi, waarabu, wazungu) ndiyo wabaguzi kuliko hata watanzania weusi wenye asili kubwa ya nchi hii kwani hawana nchi nyingine ya kukimbilia zaidi ya hapa.

TZ law clearly states that all the land belongs to the state. No one OWNS land in Tanzania! An individual can be allocated land for whatever use on leasehold terms but the state holds the mandate to revoke the lease for various reasons.
For example if one has a huge farm with all legal documents in place etc, and oil is found below the ground, the government therefore reserves the right to cancel the title deed and compensate the "owner" for what he has developed above ground.
Similarly, an open space can be created even when there was none before if the govt deems it necessary and can afford to compensate and relocate the people involved. That's why and how TANROADS has been demolishing peoples' homes along trunk roads throughout the country for "road reserve" space.
As far as I know nothing has yet been developed at the controversial plot except for the wall of which Mr Muccadam has every right to claim compensation for.
Having said that, it's quite obvious certain inept and corrupt individuals within the state's organs are culpable of having contributed negatively into the whole of this saga.
It will only be fair if they are also brought to task and pay for their ineptitude and/or corruptness.

Lakini lazima sheria ziwe za haki pale ambapo serikali inaamua kumiliki ardhi ya mtu japo ana kibali na makaratasi yote kwa kuwa kuna mafuta chini ya ardhi na kadhalika. Hapa utakuta mtu ananyimwa haki yake na anapelekana kortini na serikali na akishinda, serikali hailipi gharama zozote wala haki yake kamili. Hapa ndio inasababisha wafanyabiashara wasije Tanzania. Kama nchi haina sheria za kibiashara zinazoheshimika, basi inawaogopesha wafanyabiashara. Tanzania kwa sasa tuna viwanda vitatu tu vikubwa: Pombe, simu za mikono na migodi. Kama tunataka wananchi wa Tanzania wapate kazi na kupata maendeleo inabidi tuzidishe mauzo na viwanda vizalishe zaidi na viwe vingi zaidi.

Hata nchi za kitajiri, mali na fedha zimeshikwa na wananchi wachache, hii ndio Ubepari. Hawa watu wachache nchi wanaolipa kodi na kuwapa kazi wananchi. Wananchi nao wanapata fedha za kuishi vizuri na serikali inapata mapato ya kuwapa mashule na matababu bora. Nchi yoyote ambayo serikali imechukua jukumu la kuendesha viwanda imefilisika. Hata China na Cuba sasa, wananchi ndio wanaendesha biashara.

Maendeleo bila ya sheria za kuwalinda wafanyabiashara ni ndoto tu. Tutabaki wakulima maisha na hakuna nchi hata moja ilioendelea kwa kuvuna mahindi tu. Tushukuru Mungu wageni wanakuja nchini kuwekezea wakati hamna maji, umeme, barabara wala elimu bora mpaka leo. Aamkeni hamna mtu atayekuamsheni.

I find no defect on what a US blogger has put forward over the ongoing land saga in Tanzania. Contrary to the views of some comments, I find the content of his/her message being logical, critical and free from biases or emotional drives. We should respect our Judicial system, legal procedures and human rights if we are to make positive strides in this backward country of ours. Mr Muccadam's victory in the High court did not happen in a vaccum. Obviously he presented relevant and lawful documents verifying his right to ownership of the plot. Where do you think did he get these documents from??? If he was granted ownership to an open space then it is undoubtful that the officials behind were corrrupt (and every blogger knows how corrupt still they are). In case they were righteous they could simply stop Muccadam and spot him as a criminal at the very point in case he approached them with "bahasha ya kaki". They would have tipped PCCB for him to face bribe charges.For longer as he holds the right documents, I find no cause to incriminate him, instead, these officials who issued the ownership and building permit while knowing exactly that that was an open space should have been number one criminals after the government's defeat in High court. And still the government could have followed legal procedures in retaking the plot by compasating him.
ReplyDeleteIt feel so bad that in your own country you get inflicted by your own people, your own leaders of whom you have entrusted them with the leadership and administrative role. Who is unaware of how corrupt land officials are? and they represent just a margin of other corrupt government officials in the public sector!! I take this incidence as an effort by the government to safeguard the corrupt interests of its officers who are infact operating in an interconnnected sort of network that can spare no leader in its ciruit! However I am hestant as well to completely arrive at that conclusion as I still look forward at seeing these corrupt authorities are brought before the court of law and that the court of law is to give final verdict that is to be respected by whoever might be.

Ukweli lile ni eneo la wazi, lkn kwa vile kipindi kile mifumo ilikuwa imejaa wizi mtu akaforge kupata vibali ambavyo hata hamna kwenye register. Sisi hatutaki wawekezaji feki, mbona Barrick zipo tunawaheshimu kwa sababu waliingia mikataba halali na wataalamu wetu.
Hakuna mtu anaweza kuamka na kuvunja ukuta bila kuwa na grounds za kweli. Na natamani huyu mtu aendelea na malumbano serikali, kwa kutetea wizi wake wa mali ya watoto atailipa serikali usumbufu na kufoji nyaraka za serikali.
Mimi nawashauri kama humo ndani ya jambo usikirimbilie conclusion, Madam Tibaijuka ni mtu makini na ameaminiwa kufanya kazi hiyo, na sisi wa Tanzania waaminifu tutampa support katika yaliyo ya kweli.

ReplyDeleteNa ningependa kuongezea kwamba pengine Bw. Muccadam alizifuata taratibu zote za Sheria alipopata umiliki wake wa eneo hilo. Lakini inawezekana kwamba kabla ya hapo kulikuwa kumefanyika mchezo wa kuipindisha Sheria na hivyo kumdanganya kuhusu uhalali wa umiliki wake hapo.
Kwa maana nyingine, inawezekana kwamba hata yeye ni "victim" katika sakata hili, na ndio maana anatafuta jinsi ya kupata suluhisho la kisheria -- sio kwamba ana ugomvi na Mhe. Waziri Tibaijuka, bali kwamba mchawi afichuliwe na kutozwa fidia ya gharama zote.
Kwa hiyo tusilichukulie hili jambo kijuu-juu kama linavyosomeka katika vyombo vyetu vya habari.

This type of bureaucracy is what deters most of us who live abroad to invest in our country. Why should I put my hard earned money into jeopardy? I'd rather put it to better use where I know that I will reap the benefits of what I sow. Tanzania, the time is due for change. Corruption has gone way too far and it is time to change for the better. Give the land back to the person who righfully owns it. I have witnessed way too many stories of 'double occupancy' --it makes one wonder why the problem continues to be perpetuated and tolerated. This is downright RIDICULOUS! And those who live in Tanzania, you are not victims of this bureaucracy---you continue to nurture the ugly system because you accept what happens instead of changing it! From, Msemakweli in America
