The Kenyans have once again smirched the operations of the East African Community (EAC) by objecting to the commencement of the construction of the new headquarters building in Arusha.

Speaking on condition of anonymity, the highly placed source informed me that, the Council of Ministers meeting, which convened on February 27th in Arusha, wasted time listening to Kenyan clamor.

The Kenyan delegation lead by the Minister for East African Cooperation, Amason Jeffar Kingi, contended that the inclusion of Rwanda and Burundi in the Community disqualifies Arusha as the center-point of the region and called for a fresh look into the matter.

Although the Kenyan officials did not mention their preference, it was apparently clear that the move was designed to make sure Tanzania does not continue to be the seat of the Community.

Common sense tells us that if a Kenyan representative objects to Arusha as the headquarters of the Community, the only possible suggestion would be Nairobi – dubbed the capital of slums and crime in the region.

Without shame, the Rwandan delegation supported the Kenyan objection, but the cool-headed Ugandans and Burundians opposed the Kenyans with perplexity.

Last year the Rwandans, like the Kenyans, were annoyed by the Tanzanian stand on the land issue. Arguably this could easily be interpreted as childish vengeance; otherwise, where did the impetus come from?

The source noted that the Tanzanian delegation led by the Minister for East African Cooperation, Dr. Diodorus Buberwa Kamala, reminded the vociferous Kenyans that the treaty states that Arusha is the headquarters.

In fact, Chapter 29, Article 136(1) states as follows: The headquarters of the Community shall be in Arusha in the United Republic of Tanzania.

When contacted for comment over the week-end, Dr. Kamala told me he was shocked and amazed at the Kenyans move to delay the construction. The minister is expected to speak with the media in Dar es Salaam some time this week.

According to Minister Kamala, the matter will have to be forwarded to the summit, which meets in April for further deliberation. He said the Community operates under the principle of consensus; thus the matter must be resolved amicably.

The Council of Ministers is the policy organ of the Community and reports to the summit, which is comprised of the presidents of the five member states, namely Tanzania, Kenya, Uganda, Rwanda and Burundi.

The Kenyan interference comes at a time when Germany has added another 6 million euros for the construction project to the earlier committed 8 million euros. The additional financial assistance came after the entry of Rwanda and Burundi in the EAC, which changed the original architectural plan.

The whole project is estimated to cost 14 million euros if completed on time in Arusha, where the government of Tanzania donated land free of charge in 2005. Currently, the Community is housed at the Arusha International Conference Center (AICC).

Although it is true that the defunct Community that collapsed in 1977 established Arusha as the headquarters based on its centrality in relation to the three capitals of Dar es Salaam, Nairobi and Kampala, the current treaty is silent on the equidistant argument.

Kenyans did not address a scenario in which another African country might join the Community in the future as has happened with Rwanda and Burundi. Will that prompt the Community to change the headquarters again? It’s absurd.

As a matter of fact, some international analysts are anticipating the possibility of Southern Sudan applying to join the Community in the near future should the cession deal from the Khartoum regime succeed in 2011.

Interestingly, a quick geographical analysis suggests that four big cities approximately meet the qualification of “centrality” in the region: Arusha and Mwanza in Tanzania, Nairobi in Kenya and Kampala in Uganda.

From observation on the map, the cities’ locations draw an irregular polygon, something that is neither a trapezoid in shape nor a rhombus, but close to a quadrilateral. Arusha is in the south-east corner of the quadrilateral, Nairobi in the north-east corner, Kampala in the north-west corner and Mwanza in the south-west corner.

Based on the actual locations of the four cities in relation to Rwanda and Burundi, which are located in the south-west of the quadrilateral shape, Mwanza reasonably meets the criteria of being in the middle of all five capitals of member states.

However, it is ridiculous that a Kenyan minister would fight to move the headquarters from one Tanzania city to another Tanzanian city that is even further from Nairobi. The Kenyan demands are laughable.

This is not the first time that Kenyans have stalled the processes in Arusha. Only last year, the Kenyans disrupted the negotiations of the Protocol on the Establishment of the Common Market demanding access to Tanzanian land and arbitrary permanent residence.

In the past, the Kenyan officials have even demanded equal employment opportunities among member states for non-skilled positions. These positions are jobs such as janitors, office messengers, watchmen, drivers, etc. The move failed.

In another incident in 2001, the Kenyans attempted to knock out the most qualified applicant in the position of the Registrar of the East African Court of Justice in favor their fellow Kenyan.

However, the no-nonsense Ugandans stopped the bad move and even threatened to quit and blow up the issue in the media. The suppressed applicant was a young Tanzanian lawyer with a doctorate degree from Britain.

The Kenyans, like the Ugandans, had four applicants against the Tanzanian, Dr. John Eudes Ruhangisa, who beat them all in all qualifications and in the interview. I met him in September 2008, and he is still serving the Community in Arusha with all his heart.

The selfishness and arrogance of Kenyan officials is blamed for the collapse of the earlier Community in 1977 after only ten years. The then Ugandan Dictator, General Idi Amin Dada, also tainted the Community with his evil endeavors.
Senselessly and foolishly, some Kenyans in 1977 drank wine to celebrate the death of the Community and grabbed everything they could from planes to pencils.

General Amin and his entire army were later overthrown by heroic Tanzanian troops in April 1979. The three countries resumed cordial relations in the mid-1980s and signed the Agreement for the Establishment of the Permanent Tripartite Commission for East African Co-operation in 1993.

The Community was later re-established on July 7, 2000, and on July 2007, Rwanda and Burundi were fully admitted into the Community.

The upcoming summit will thus have to decide on the fate of the headquarters. It is unlikely that the headquarters will be changed just to satisfy egocentric and incongruous behavior.

It is very unfortunate that the Kenyan regime, after grabbing power over the dead bodies of slaughtered hungry Kenyans, now wants to export impishness to everywhere in the region. Shame!

  5. Thanks for the Article Mr. Matinyi,

    It is very difficult figuring where your argument is headed to though.

    You missed it, Kenya is not interested in hosting the EAC HQ. The heart of the problem is that Kenya and Rwanda doubt if Tanzania is really committed to the future of the EAC. Don't substitute this point with your own propaganda.

    If Tanzania pulls out of the EAC sometimes in the future (this looks imminent), a change of the HQ would be necessary and expensive.

    The pressing issue now is that Tanzania unequivocally states her committment to the future of EAC sooner than later. With all due respect, if Tanzania is taking long in deciding what kind of EAC she wants to belong to, then the rest of EAC is entitled to applying the same delay tactics to stall building of the EAC until it is clear whether Tanzania is for EAC or not.

    Kindly argue for Arusha remaining the seat of EAC especially in the light of Tanzania's recent reservations regarding land and travel documents.

    It is sad that you misrepresent EAC issues and hence cheapen this blog by advancing your anti-Kenya, anti-Kenyans, and anti-Nairobi sentiments.

    "Nairobi – dubbed the capital of slums and crime in the region" - this is laughable, the "capital of slums and crime" is the seat of UNEP worldwide.

  10. Hawa wakenya Vipi? Ina maana kila tunavyoongeza nchi tutahanmisha makao makuu? fikiria siku tu7meongeza somalia, Sudani, Ethiopia. labda hata Kongo, Msumbiji hata Misri na zinaongezeka kila baada ya miaka 10, tutahamisha makao makuu mara Ngapi? wazembe kweli hawa?

    EU ziliongezeka moja moja kwa muda mrefu sana na bado zingine zinaomba kuongezeka lakini makao makuu ni Brussels siku zote.

I could sense some kind of mischief coming out of some quarters deliberately intended to provoke a useless and nonsensical debate!Whatever the pretext,all will be said but when it comes to the LAND ISSUE and UNWANTON FREE LABOUR MOBILITY among the partner states,those issue must wait!Nobuddy is going to push us Tanzanians into any such deal without ill intentions.Free access to Land and Unrestricted Labour Mobility should never be allowed to be set as a PRECONDITION for anything,be it the construction of new Community Head Offices in Arusha or elsewhere or any Common Market Matters!Any insistence on those issues on the part of Rwanda and Kenya will signify a mischievous hidden agenda for which Tanzania is well prepared to handle.after all the East African Common Market can always wait,for we still have a lot of more pressing social agenda back at home!We dont have the industries to worry about,BUT Kenya has a lot of industries to think about!We have plenty of agricultural Land for our people,BUT Kenya has a shortage of arable Land for her people!So let nobuddy rush us into something without coming to terms with the impending consequences of such actions in the domestic front!Every country in EAST AFRICA needs a Common Market,but one without any PRECONDITIONS!the intended new structures of the EAC Headquarters should not be allowed to take us as "Hostages to the Looming Crisis".Tanzanians are just too clever for that gimmick!---papperazzi antonnio-----

    UN staff in Nairobi protest changes effected March 1 by UN Secretary General Mr Ban Ki Moon, where Mrs Tibaijuka was replaced as the Director General UN Office in Nairobi but retained her post as the Executive Director of UN Habitat.


    Mrs Anna Tibaijuka has been replaced as the Director General of the United Nations Office in Nairobi.

    The position has consequently been taken over by Mr Achim Steiner, who is also the United Nation’s Environmental Programme Executive Director.

    Mrs Tibaijuka however retains her post as the Executive Director of UN Habitat.

    The changes, which were effected on March 1, were done by UN Secretary General Mr Ban Ki Moon.

    However, on Tuesday, a section of the UN staff led by their Union President Mrs Rhoda Atana, protested at the move to replace Mrs Tibaijuka terming this as unfair.

    And they took issue with process to replace Mrs Tibaijuka saying it lacked respect for ‘gender and diversity’ principles within the UN system.

    “Where is that gender and geographic balance where the only UN headquarter duty station headed by a woman is transferred to a man with no justification?” she posed.

    Added Mrs Atana, “Where does the Secretary General’s report on improvement of the status of women in the UN system, discussed at the 63rd of the General Assembly, take us?”

    “We have nothing against Mr Steiner, but are disturbed by the process followed in the replacement of Mrs Tibaijuka,” said Mrs Atana.

    She went on, “We have high confidence in the Office of Secretary General (Ban Ki-moon) but we would like to express our utmost confidence in Mrs Tibaijuka’s performance.”

    Mrs Atana, who was addressing the media at the Unep Complex in Gigiri, expressed concern with the criteria used in replacing her as Director General of the UN Nairobi office.

    The timing of her replacement, she added, was wrong coming at a time when the UN Habitat Governing Council was scheduled to meet at the end of the month.

    “This does not augur well for her... she has worked hard to reform Unon and would have concluded her term with even greater reforms,” said Mrs Atana.

Mobare Matinyi hili bonge la hoja umetoa, lakini tujue fika Wakenya wameangalia zaidi maslahi yatakayotokana na uwepo wa Makao Makuu ya EAC, ikiwa yatakuwa kwao Kenya, ina maana fursa za ajira kama madereva,watunza bustani,wapishi,walinzi, mahouse girl na House boyz zitaongezeka sana kwao achilia mbali other major posts, vilevile biashara ya hoteli ya utalii kwa ujumla vitaongezeka kwa kasi kubwa, si unajua wanavyojitangaza kwa fujo? Sasa watasema rasmi kuwa ukifika Kenya umefika Afrika Mashariki, hili sio wazo baya kwao ila ni muendelezo wa "Harambee" yaani maslahi ya Wakenya kwanza.
    Wadau wanaowasapoti wakenya,hawajui kwa walitendalo tunapaswa kuwaelimisha taratibu wataelewa na watattusaidia sana kutetea maslahi ya Tanzania huko tuendako.

  22. Mimi sijawahi kuona watu wa ajabu kama sisi Watanzania! Yaani Wakenya wanataka kutupiga bao halafu sisi tunagombana wenyewe? Tuamke jamani, hii si dunia ya kulala na kusema wakichukua waache wachukue kama tulivyofanya mwaka 1977 na Nyerere wetu. Arusha ni makao makuu na hakuna kubadili. Mimi nakwenda Nairobi mara kibao, sioni lolote la maana zaidi ya magorofa ya wezi tu.

Tanzania tumekataa kuwapa ardhi sasa mnasema eti hatuko serious na Jumuiya. Nani aliwaambia kuwa Jumuiya lazima ardhi ya Tanzania ichukuliwe na Wakenya na Wanyarwanda? Matinyi yuko sahihi, hajafanya propaganda, mnataka ardhi ndiyo maana sasa mnahangaika kutaka kuchukua makao makuu kama kisasi. Hampati kitu hapa.

    I would like to concur with you in thanking mr matinyi for his article, and also in stressing the fact that kenya has no where expressed a desire to be the HQ. If it has that in its agenda, then its playing a hidden hand very tactically and that is for the politicians to find out.

    however, I think stalling a development project just because tanzania refused to accede to some demands on policy does not make sense. Tanzania is willing to go ahead with the union, only that due to its internal conditions and recent developments as regards her security, Tanzania feels it's not viable to accede to free mobility, labor and land laws - simple. It's amazing how other countries brand tanzania as not forward thinking, but if only they could put themselves in Tanzania's shoes then they can tell us how they would react. Everybody, esp Kenya is set to gain lots and it's to Kenya's advantage that the Union be formed quickly and the land and labor laws be ammended. It's in Tanzania's best interest for land to remain public property ,and it has to a great measure sustained the peace and tranquility that exists, together with other measures.

    I would implore all people looking into the matter, and we humble bloggers here to think of the sustainability of any suggestions we make.

    And Mr Matinyi, thanks for the article but I feel it's biased and bent towards branding Kenya as a thug nation. Be balanced next time, I can only imagine how good you can be in a balanced environment....

MY FELLOW TANZANIANS ITS A TIME TO WORK UP AND CHALLANGE THESE GUYS,we have been sufferings from these guys in every angle,i think if these Kenyas were having human hearts they cld realise that they don't have the best friends than tanzanians,just few months they have been killing eachother coz of election and its tanzania who resolved their conflict,but everywhere in the world where u will find a kenyan they consider tanznaias as dtupid people and people who don't have direction,but for sure if people have started showing their differences in this process of forming the federation how are we going to sit on the same table having the same leader and the same constitution,i real support the editer and we as tanznians should stand together supporting and advising our leaders of what we real want,together we shall reach there and no matter how these stupid kenyans consider us,for my opinion tanzania is a big country and we have amot of potentials,MUNGU IBARIKI TANZANIA

  31. Kama Watanzania hatuwezi kuona hili balaa linaloelezwa hapa kwenye hizia aya, basi tuna mdudu kichwani........

    This is not the first time that Kenyans have stalled the processes in Arusha. Only last year, the Kenyans disrupted the negotiations of the Protocol on the Establishment of the Common Market demanding access to Tanzanian land and arbitrary permanent residence.

    In the past, the Kenyan officials have even demanded equal employment opportunities among member states for non-skilled positions. These positions are jobs such as janitors, office messengers, watchmen, drivers, etc. The move failed.

    In another incident in 2001, the Kenyans attempted to knock out the most qualified applicant in the position of the Registrar of the East African Court of Justice in favor their fellow Kenyan.

  34. Bro Michuzi na wadau wote, mimi naungana na mdau wa kwanza hapo juu kuzungumzia jinsi hii mada ilivyowasilishwa. Wakati naunga mkono hii mada kuletwa hapa ukumbini ili tuijadili na ikiwezekana tupate suluhisho lake, simuungi mkono mdau Matinyi kwa jinsi ambavyo ameianika hii mada kwetu. Mara nyingi (hasa kwenye hili suala la EAC) Mdau amekuwa akitumia lugha ya Msuli (Jazba) sana kufikisha ujumbe kwa Watanzania.Inawezekana kuwa ni maumbile au ndio namna yake ya kuongea na hadhira yake.Najua Matinyi ana uchungu sana na Nchi yake kwahiyo asingependa kuona tunanyanyaswa na watu wengine kwa namna yoyote ile. Hata hivyo mimi kwangu naona kutumia lugha ya jazba (na wakati mwingine matusi) namna hii sio kujenga, bali ni kuendeleza chuki, sio tu kati ya members of EAC bali hata kati yetu watanzania. Ikumbukwe kuwa sasa hivi tumeshajichanganya kwa kiasi kikubwa sana, kuna baadhi ya watanzania wenzetu wameoa au kuolewa nchi za jirani (mfano tu mh. mkuu wa wilaya ya tegeta....tehe..tehe..)na hivyo kufanya sehemu ya familia za watanzania wenzetu. Sasa tunapotumia lugha ambayo inajenga chuki kati ya watu wawili wanaoishi nyumba moja (in particular chumba kimoja)ni wazi kuwa siku moja hawa watu wanaweza kuchinjana ndani ya nyumba. just imagine unasema Mganda anatabia mbaya (kwa mfano tu)wakati mheshimiwa hapa jioni anaenda kupata lunch ya usiku pamoja na mganda na half 'Wagandas', unategemea nini kitatokea hapo mezani au chumbani kwake? najua busara itatumika kwa shemeji yetu, lakini sio wote wanaoweza kutumia busara.Nafikiri kuna njia nyingi za kufikisha ujumbe na watu wakaweza kukuelewa na kutoa mchango unaouhitaji. Mfano leo nimeona the same story kwenye vyombo vya habari vya IPP, lakini sijaona mwandishi aliyetumia lugha kali kama ya Matinyi. Kumbe hata kwenye baraza la Mawaziri la Kenya hii habari haijajadiliwa.     Waziri wa Ushirikiano wa Afrika Mashariki, Dk. Diodurus Kamala, leo anatarajia kutoa msimamo wa serikali kuhusu pendekezo lililotolewa na Waziri wa Kenya anayeshughulikia masuala ya Afrika Mashariki, Amason Kingi la kutaka makao makuu mapya ya Jumuiya ya Afrika Mashariki (EAC) yahamie nchini mwake badala ya Arusha.

    Dk. Kamala aliliambia Nipashe jana kuwa atatoa msimamo huo atakapokutana na waandishi wa habari katika ofisi za wizara yake jijini Dar es Salaam leo.

    Nipashe ilikuwa imemtaka kueleza msimamo wa serikali kuhusu mapendekezo ya Waziri Kingi.

    Hatua hiyo inatarajiwa kuchukuliwa na Dk. Kamala ikiwa ni siku tatu tangu Waziri Kingi kuonyesha dhamira yake hiyo kwa kupendekeza makao makuu mapya ya EAC yasijengwe Arusha, ambako pamekuwa makao makuu ya Jumuiya hiyo tangu ilipofufuliwa mwaka 1999.

    Waziri Kingi ameripotiwa kutoa pendekezo hilo kwenye kikao cha Baraza la Mawaziri wa EAC, kilichofanyika Arusha Februari 27, mwaka huu akisema makao makuu yahamishwe kwa sababu Arusha siyo tena katikati ya eneo la nchi wanachama wa Jumuiya hiyo.

    Pendekezo hilo liliungwa mkono na Rwanda, ambayo ni moja ya nchi mbili mpya katika EAC.Arusha ndio mji unaotajwa katika Mkataba wa Kuanzishwa EAC kuwa itakuwa ndipo Makao Makuu ya Jumuiya hiyo.

    Hata hivyo, nchi za Tanzania, Uganda na Burundi zimeripotiwa kupinga pendekezo hilo na habari kutoka Nairobi, Kenya zilieleza kuwa hata Baraza la Mawaziri la Kenya halijapata hata wakati mmoja kuzungumzia wazo au pendekezo la kuhamisha makao makuu ya Jumuiya kutoka Arusha.

    Kenya's President Mwai Kibaki has threatened to sue anybody who says he has a second family.

    The President, who appeared uncharacteristically furious, called a rare press conference on Tuesday at State House, Nairobi attended by the First Lady to state that he had only one wife, Mrs Lucy Kibaki, and four children.

    With the First Lady standing by his side, the President accused the media of continuously publishing lies about his marital status, saying he had publicly clarified facts about his family twice.

    “Everyone knows that I am married and I only have one wife. The media keep reporting that I have another wife or wives. I have only one wife and I don’t have any other,” he said.

    The President admitted that he was angered by the claims, saying: “I have gotten in this foul mood after listening to some statements that were made yesterday (Monday), the other day or even recently. I want to state that anyone who is bent on that course will see me in court or wherever he will see me. There is no other way.”

    President Kibaki, with pain and anger, started by introducing the First Lady. “This is my dear wife Lucy, and I want to say something that I hold dear in my heart to you. I only have one wife and four children. You know their names and if you don’t know, you can ask me. I will tell you.”

    He said lies were being told about his family and challenged the media to tell the public the truth.

    “I don’t know why people are spreading lies about me because I am a genuine person who doesn’t tell lies. It doesn’t help anybody to tell lies,” he said.

    The President also explained that his relatives were well known and appealed to the public to ignore any other allegations.

    Statements

    He then said he had been driven to the point of restating his marital status due to statements made by former Kabete MP Paul Muite on Monday.

    Mr Muite remarked that the government ordered a raid on the Standard Group three years ago to stop it from publishing a story on the composition of the President’s family.

    He made the remarks at a function to mark the third anniversary of the 2006 raid on the Standard offices during which equipment was vandalised and computers confiscated.

    On Tuesday, he claimed the information about the alleged reason for the raid was given by Mr John Michuki, who was the Security minister when he appeared before the Parliamentary Committee on Administration and Legal Affairs, which Mr Muite chaired at the time. Mr Muite said he would neither retract his claims nor apologise.

    First Lady Lucy singled out KTN and expressed her anger at the station for allowing Mr Muite to speak “falsehoods” against the First Family.

    Pointing at a KTN reporter, she said: “You are from KTN? Last night I nearly came to your offices to attack you the same way I did to Nation.

    "You allow foreign diplomats, international journalists, name them, to listen to somebody called Muite tell lies. The President may not take him to court but I and my family will take him to court. Tell him that.”

  46. It is clear that the Tanzanian government needs to outline clearly mwelekeo wake as far as EAC is concerned...EAC HQ is a long term project and a serious investment. I thought it was a wake up call! 21th century requires a timely response to issues...Tutaangalia kind of business is over! Tanzanian stands are legitimate and clear... but it needs to put them into perspective especially as far as the future is concerned..!Some of needs to stop to be haters though, there will always be people with a different opinion!

    Tanzania ilichukua AICC ambayo ilijengwa na EAC ya kwanza. Sasa AICC imewamea watanzania kiasi cha kuikodishia EAC Mpya maofisi kama ambao ni wageni!! Mbona hayo hamyasemi? Itakuwaje mtu kulipia kodi nyumba yake mwenyewe.

    Ni wazi kwamba watanzania hawako tayari kuendelea na EAC. wako tayari kubaki na SADC. Sasa ikiwa mumedhihirisha nia yenu kwa majirani, kwa nini majirani wasijipange mapema?

    Enyi watanzania, mumeonyesha kwa matendo, maandishi na mienendo kwamba mwataka kuwanyonya wenzenu.
